Breast Cancer Has Been Specifically Excluded From Federal Zantac Cancer MDL

Monday, January 24, 2022 - With more than 125,000 people accusing Sanofi, the maker of Zantac heartburn and acid reflux medicine, of causing cancer, MDL judge Robin Rosenberg has decided to limit the number of types of cancer that Zantac allegedly caused to cancer of the Bladder, Stomach, Liver, Pancreatic, and Esophagus. What has been glaringly omitted from the list is breast cancer, a disease that strikes women primarily, causing concern for those who think they have developed breast cancer specifically from taking Zantac ranitidine. Some women have filed Zantac lawsuits in state courts like the one in California to take advantage of more liberal-leaning juries that could side with the plight of the simple man against large, greedy corporations. The immediate problem that Zantac breast cancer plaintiffs may have in state court is trying to explain why their claims did not hold water before the Federal MDL Judge.

Thousands of heartburn medicine cancer lawsuits have been organized on the federal level into multidistrict litigation (MDL) where repetitive administrative court procedures are simplified saving the system thousands of hours or repetitive work and countless dollars. An MDL judge has the responsibility to review the science that underlies the cancer claims of the plaintiff's pool all of whom have suffered relatively similar injuries from taking the same medicine or using the same product. Other examples of cases with thousands of plaintiffs that have similar injuries from the same product are those who allege that using Johnson's Baby Powder caused them to develop ovarian cancer, people who have non-Hodgkin's lymphoma from coming into contact repetitively and for many years with Roundup herbicide made from glyphosate, and also US Army soldiers who came home from fighting in the Gulf Wars with hearing loss and tinnitus after their standard-issue army earplugs failed to protect their hearing and allegedly caused permanent, irreversible hearing damage.

The most recent Zantac Breast Cancer claim filed in state court was on behalf of a woman who was diagnosed with cancer in 2014 and filed suit on April 19, 2021, in Los Angeles, CA. According to AboutLawsuits.com, "Marina Golden in California Superior Court for Los Angeles County on April 19, presenting claims against various manufacturers and retailers, including Sanofi-Aventis, (other generic ranitidine manufacturers), CVS Pharmacy, Inc., The Kroger Co., Walgreen Co., Walmart Inc, Albertsons Companies, Inc., and Rite Aid." AL reported that the lawsuit claims that "Plaintiff has been diagnosed with breast cancer because of ingesting carcinogenic Ranitidine-Containing Drugs due to Defendants' willful misconduct and gross dereliction of duty," the lawsuit states. "Had she known that Ranitidine-Containing Drugs would wreak such havoc to her body, Plaintiff would not have purchased or ingested any Ranitidine-Containing Drug." MDL Judge Robin Rosenberg, having once been celebrated for her selection of attorneys representing a diverse pool of women, non-experienced and experienced, and ethnically diverse attorneys, having reviewed the science behind Zantac cancer in Daubert hearings called "Science Day" in September of 2021, decided that breast cancer would not make the MDL list. Attorneys for Ms. Golden will have to explain why cases of breast cancer are not strong enough to hold water and be included on the federal level.
