Scientific Issues In Zantac Multidistrict Litigation Will Be Decided And Bellwether Trials Scheduled

Complex scientific testimony is being examined during hearings underway in the Zantac multidistrict litigation

Monday, December 6, 2021 - Multidistrict litigation has many benefits for plaintiffs, defendants, and the legal system as a whole. In particular, MDL is the preferred method of litigation in cases involving complex scientific issues where hundreds or thousands of plaintiffs have similar injuries from using the same product or taking the same drug. Issues of science are largely decided during a series of hearings called Daubert hearings. During these hearings the federal judge that presides over all of the MDL for individual case interviews the best several scientific experts that the plaintiffs and the defendants wish to call during the trials that will come. The judge's responsibility is to eliminate those witnesses that are weak on facts and long on hyperbole, and likely to inflame emotions rather than present the pure facts. The judge in MDL Daubert hearings does not decide guilt or innocence but creates a list of expert witnesses each side can call. The side with the weaker factual presentation of the scientific evidence underlying each case may be encouraged to settle cases out of court rather than waste efforts on what could be an obvious outcome. Cases that involve complex science like Zantac ranitidine cancer, talcum powder cancer, or others, could be decided before they start. The results of the scientific hearings are highly anticipated by all concerned. People that want to join the Zantac cancer multidistrict litigation must register their intent with the court through a Zantac cancer attorney. There are currently more than 100,000 heartburn medicine cancer plaintiffs that have registered their claims that using Zantac heartburn and acid reflux medicine caused them to develop stomach cancer, bladder cancer, esophagus cancer, and other types of deadly diseases.

While we are not privy to information about what is happening during the Daubert hearings, experts agree that the Zantac Science hearing that occurred on December 2, and 3, last week centered on the accusations made by David Light, CEO of online testing pharmacy Valisure Inc. In late 2019, Valisure tested Zantac ranitidine and discovered N-nitrosodimethylamine (NDMA) orders of magnitude greater than the 96 nanograms per tablet the Food and Drug Administration deemed to be safe. Some said the company found up to 3 million nanograms of the deadly carcinogen in some samples. The defense may argue that the testing methods that Valisure used overheated the ranitidine samples and were the cause of the NDMA spikes. The Food and Drug Administration seems to agree with the defendants as the agency is on record saying that their testing of ranitidine left them thinking that there was nothing to worry about.

The FDA said, "The agency has tested numerous ranitidine products on the market over the past few months, and today we're releasing a summary of the results we have to date. Through our testing so far, we have found levels of NDMA in ranitidine that are similar to the levels you would expect to be exposed to if you ate common foods like grilled or smoked meats. We also conducted tests that simulate what happens to ranitidine after it has been exposed." The tests included simulations of stomach acids that could be expected if one ate a standard diet.
